Terms & Conditions

Last updated: 25 September 2026
Effective date: 25 September 2026
Version: 1

These Terms & Conditions (the "Terms") form a legally binding agreement between you ("you", "your", or the "User") and Arexian Hub ("Arexian Hub", "we", "us", or "our") governing your access to and use of the Arexian Hub platform, including all associated websites, mobile applications, services, and integrations (collectively, the "Services"), including the optional KineticAI biomechanics analysis add-on (the "KineticAI Add-on").

By creating an account, signing in, or otherwise using the Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Services. Your acceptance is recorded against your account, including the version number, timestamp, and originating IP address, and may be tendered as evidence of your agreement.

1. Definitions

  • "Club" means a sports club, academy, or organisation registered on the Services.
  • "Coach" means a user who manages teams, players, sessions, or analytics within a Club.
  • "Player" means a player profile created and managed within a Club, who may be a minor.
  • "Parent" or "Guardian" means a user with linked access to one or more Player profiles.
  • "KineticAI" means the third-party biomechanics analysis service integrated as an add-on, processing video of Players to produce movement and injury-risk metrics.
  • "Personal Data" has the meaning given in the EU/UK General Data Protection Regulation.
  • "Special Category Data" includes health and biometric data as defined in the GDPR, which KineticAI analysis may generate.

2. Eligibility & Age

2.1 General eligibility

You must be at least 16 years old to create an account. By registering, you represent and warrant that you are of legal age in your jurisdiction to enter into a binding agreement and that the information you provide is accurate.

2.2 Minors and parental consent

The Services are used by Coaches to manage Players who may be minors. Under the EU GDPR (and the UK GDPR and Irish Data Protection Act 2018), the processing of a child's Personal Data on the basis of consent requires that consent be given or authorised by the holder of parental responsibility. In Ireland and the United Kingdom, the age below which parental consent is required for information society services is 16.

Under the United States Children's Online Privacy Protection Act (COPPA), verifiable parental consent is required before collecting Personal Data from a child under 13.

You acknowledge that:

  • If you are a Coach or Club owner, you are responsible for obtaining all necessary parental or guardian consents before creating a Player profile or submitting any Player to KineticAI analysis.
  • You must not submit any Player to analysis or share any Player data without lawful authority to do so.
  • Arexian Hub may request evidence of consent and may suspend access where consent cannot be demonstrated.

3. Accounts & Registration

3.1 Account creation

You must provide accurate, current, and complete information during registration and keep it updated. You are solely responsible for maintaining the confidentiality and security of your account credentials and for all activity under your account.

3.2 Acceptance of Terms is mandatory

Acceptance of these Terms is a mandatory condition of creating an account and continuing to use the Services. Your account record stores the Terms version you accepted, the date and time of acceptance, and the originating IP address. If we publish a new version of these Terms, you will be required to accept the updated Terms at your next sign-in before you can continue using the Services.

3.3 Account suspension & termination

We may suspend or terminate your account at any time if you breach these Terms, if required by law, or to protect the safety, integrity, or rights of other users, Players, or Arexian Hub.

4. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable law.
  • Submit any Player to analysis or share data without lawful authority and, where required, verifiable parental or guardian consent.
  • Upload, store, or share content that infringes the intellectual property or privacy rights of any person.
  • Attempt to gain unauthorised access to any part of the Services, another user's account, or any system or network connected to the Services.
  • Introduce malware, viruses, or any malicious code.
  • Use the Services to harass, discriminate against, or harm any person, including minors.
  • Reverse engineer, decompile, or disassemble any part of the Services except as permitted by applicable law.
  • Scrape, mirror, or use automated tools to extract data from the Services without our written consent.

5. User Content & Data

5.1 Ownership

You retain ownership of the content and data you submit ("User Content"), including Player profiles, session notes, videos, and media. You grant Arexian Hub a worldwide, non-exclusive, royalty-free licence to host, store, process, and transmit your User Content solely as necessary to provide the Services to you.

5.2 Responsibility for User Content

You are solely responsible for your User Content and for ensuring you have all rights, consents, and authorisations required to submit it, including the rights of any Players (and their parents or guardians) featured in it.

6. Privacy & Data Protection

6.1 EU, UK & Ireland

We act as a data controller for the Personal Data we process to provide the Services. We process your Personal Data in accordance with the EU General Data Protection Regulation (Regulation 2016/679), the UK GDPR, the Data Protection Act 2018 (Ireland), and the UK Data Protection Act 2018.

Our lawful bases for processing include contract performance (providing the Services), legitimate interests (security, analytics, service improvement), consent (where you opt in), and legal obligation. Our Privacy Notice, available within the Services, describes the categories of data, purposes, retention periods, and your rights.

6.2 Your rights

Depending on your jurisdiction, you may have the right to:

  • Access, rectify, or erase your Personal Data;
  • Restrict or object to processing;
  • Receive your data in a portable format (data portability);
  • Withdraw consent at any time (without affecting processing already carried out);
  • Lodge a complaint with your supervisory authority — in Ireland, the Data Protection Commission (www.dataprotection.ie); in the UK, the Information Commissioner's Office (ico.org.uk).

6.3 United States

If you are a resident of California, you have rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), including the right to know, delete, and correct your Personal Data, and to opt out of the "sale" or "sharing" of Personal Data. We do not sell Personal Data. To exercise these rights, contact us using the details in Section 16.

Residents of other US states may have comparable rights under their state consumer privacy laws. We will respond to verifiable requests in accordance with applicable law.

6.4 Children's privacy

We do not knowingly collect Personal Data from children without verifiable parental consent where required by COPPA or equivalent EU/UK law. If you believe a child has provided us with Personal Data without consent, please contact us and we will take steps to delete it.

6.5 Data retention

We retain Personal Data only as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. Anonymised, aggregate metrics may be retained for analytics and trend reporting where permitted.

6.6 International transfers

Your data may be processed in countries outside your jurisdiction, including the United States and EU member states. We rely on appropriate safeguards, such as Standard Contractual Clauses, and only transfer data where adequate protection is in place.

7. KineticAI Biomechanics Analysis (Special Terms)

7.1 What KineticAI does

KineticAI is an optional add-on that analyses video of a Player's movement using computer vision to produce biomechanics metrics, including joint angles, balance risk, performance scores, and injury-risk assessments. These metrics may constitute Special Category Data (health and biometric data) under the GDPR and UK GDPR.

7.2 Integration model

KineticAI is an isolated, secure add-on. Video is captured via a single-use authorisation hand-off and processed by KineticAI; Arexian Hub stores the resulting analysis summary. The two services are technically and contractually separated.

7.3 Your responsibilities

By using the KineticAI Add-on, you acknowledge and agree that:

  • Lawful basis & consent: You are responsible for establishing a lawful basis (typically explicit consent) before any Player is submitted to KineticAI analysis. For Players who are minors, you must obtain and be able to demonstrate verifiable parental or guardian consent as required by the GDPR, UK GDPR, Irish Data Protection Act 2018, COPPA, and any applicable US state law.
  • Health data: KineticAI outputs may reveal health or injury-related information about a Player. You must handle this as Special Category Data and comply with any additional safeguards your jurisdiction requires.
  • Accuracy: KineticAI metrics are analytical estimates, not medical diagnoses. They must not be relied upon as a substitute for professional medical advice. We and KineticAI accept no liability for decisions made solely on the basis of KineticAI outputs.
  • Retention & anonymisation: Biomechanics analysis records are retained and eventually anonymised in line with the published retention policy. You may request earlier deletion.
  • Data sharing: Analysis results are shared within the Club context to which the Player belongs, subject to the Club's subscription entitlements and the roles and permissions configured by the Club.

7.4 Separation of liability

Arexian Hub is not the data controller of the video processed by KineticAI for the purpose of generating the biomechanics analysis; the Coach/Club submitting the analysis is. Arexian Hub is the controller of the stored analysis summary integrated into the Services.

8. Subscriptions, Billing & Payments

8.1 Subscription plans

Clubs may subscribe to a paid plan with monthly or annual billing. Plan details, limits, and pricing are displayed within the Services and may be administered by Arexian Hub. We may change pricing on reasonable notice; existing subscribers are notified before any change takes effect.

8.2 Payment processing

Payments are processed by Stripe (Stripe Payments Europe Ltd., and Stripe Inc. in the US). Stripe is the merchant of record for payment processing. By subscribing, you authorise Stripe to charge your payment method and you agree to Stripe's terms, available at stripe.com/legal.

8.3 KineticAI Add-on billing

The KineticAI Add-on may be purchased as an individual Coach add-on or as a Club-level entitlement, as shown in the Services. Refunds, where applicable, are handled in accordance with Section 8.4.

8.4 Refunds & chargebacks

Subscription fees are generally non-refundable except where required by law. If you are an EU/UK consumer, you may have cancellation rights under consumer law; contact us to exercise them. Unauthorised chargebacks may result in account suspension.

9. Intellectual Property

The Services, including software, design, text, graphics, logos, and trademarks, are owned by Arexian Hub and its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Services without our written consent.

10. Disclaimers

10.1 General disclaimer

The Services are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10.2 No medical advice

KineticAI outputs and any analytics or insights provided by the Services are not medical advice. Always consult a qualified professional for medical or injury-related decisions.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Neither Arexian Hub nor KineticAI shall be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Services.
  • Our total aggregate liability for any claim arising out of or relating to the Services shall not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, or for fraudulent misrepresentation.

12. Indemnification

You agree to indemnify and hold harmless Arexian Hub, its affiliates, and KineticAI from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your User Content; (b) your breach of these Terms; (c) your failure to obtain required consents for any Player; or (d) your violation of any law or third-party right.

13. Term, Suspension & Termination

These Terms begin when you accept them and continue until your account is terminated. You may delete your account at any time from Settings. We may suspend or terminate access immediately for breach of these Terms. Upon termination, your right to use the Services ceases; we will retain data as permitted by our retention policy and applicable law.

14. Governing Law & Dispute Resolution

14.1 EU, UK & Ireland

These Terms are governed by the laws of Ireland for users resident in Ireland, and by the laws of England and Wales for users resident in the United Kingdom. For EU/UK consumers, the mandatory consumer protection provisions of your country of residence apply.

Disputes will be resolved in the courts of Ireland (for Irish users) or England and Wales (for UK users), except that you may bring proceedings in your country of habitual residence if you are a consumer, and nothing in these Terms prevents you from bringing a claim in your local consumer-protection body or seeking redress through the relevant Online Dispute Resolution platform.

14.2 United States

For US users, these Terms are governed by the laws of the State of Delaware without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Delaware. If you are a US consumer, nothing in these Terms waives any non-waivable consumer rights you have under your state's law.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will publish a new version within the Services. Material changes will be notified to you, and you will be required to accept the updated Terms at your next sign-in before continuing to use the Services. Continued use after the effective date constitutes acceptance of the updated Terms.

16. Contact

If you have questions about these Terms, your data, or your rights, please contact us:

  • Through the Contact page within the Services; or
  • Via the support email listed in your account settings.

For data protection enquiries in Ireland, the supervisory authority is the Data Protection Commission (www.dataprotection.ie). In the UK, it is the Information Commissioner's Office (ico.org.uk). In the US, you may contact your state attorney general.

_By creating an account or continuing to use the Services, you confirm that you have read and accepted these Terms.
